Many manufactures and artists thrive on letting fans have their way. Examples would be: VW, The Greatful Dead & J.K Rollings.

Actually, VW had gone bonkers on RC bodies that use the "Bug" shape, Horizon Hobby/Losi and HPI Racing had to discontinue all of the "Beetles" they produced, both licensed and un-licensed in the past few months.

Revell has also discontinued all of their NA$CAR licesned models because of exessive fee's requested by NA$CAR and their sponsors.

you've obviously never run your own buisness. basically, you create your LLC to take the heat in case something like this happens. the LLC gets sued and taken for all ITS assets, and you, as an employee of your buisness are not held liable. if you are making products and selling them you should seriously be running all your operations through a LLC.

being out for profit or not, its pretty much a CYOA backup plan. selling stickers and such to help keep the forum going and what not is how the world works. what do you think pays for this website? we arent writing checks to some personal bank account here, naxja is an organization.

As I remember, because of their complexity in setting up, and their tax advantages, most LLCs are used for businesses which turn a profit. In many States, you can incorporate as a "Not for Profit" and get the same shielding advantages with a fraction of the paperwork.

As for "PERIOD" boy, we are not talking about for profit businesses, we are talking about "not for profit" Fan sites and if it is the Trademark holders obligation to give these sites the smackdown for using the Trademark of the product they are a fan of.

Jeff's position is that it is absolutely the obligation of a Trademark holder to persue their Fans. I say it's not their "obligation" and gave examples where the Trademark holder has not only allowed, but encouraged that supposed "violation".

All of your examples are Manufactures, so I don't see the point you are making.
 
I don't know if it's just me, but did the idea that it's just a ranger ever pop into your head? A ford ranger, it's nothing special that's really worth fighting over.

It wouldn't surprise me in the least if it *HAD* ended up in court. As there's no market overlap, or trademark dilution, I'd expect it to be ruled as a non-infringement.

But the courts have to decide that. Ford can't.
 
We had to agree to restrict the distribution of the merchandise to payed club members to be able to continue to use the name for our purposes.

What a lot of people forget is this, what if it was YOUR copyright that was being infringed? What if your hard work, swear, money and tears went into the enterprise that was represented in YOUR logo? These very same laws are designed to protect us “little guys” as much as they protect large corporations. If somebody was using MY logo on a shirt or in some other manner they would do it MY way or not at all; it’s MINE and I don’t want it misrepresented.
It may not have a Ford logo on it, but when that shoe is on the other foot it doesn’t fit so well.

Folks, a bunch of you are missing the point.

Ford (or any other trademark owner) does *NOT* have the ability or obligation to decide whether or not to pursue a use of their trademark, period. If the trademark owner does not actively take measures to protect it, they will *LOSE* their trademark. The courts in this country have said for years that it's a court decision on infringement, and a court's alone. There's a monetary value attached to each and every trademark and servicemark Ford owns, and they can't afford to let anybody use it without restriction.

I don't know what the status is on Ford's use of the name Ranger. If Ford no longer maintains the trademark, it's fair game. But if Ford does own the term, anybody who uses the term, and exchanges money as a result (say, a paid membership to TRS?) Ford has a responsibility to their shareholders to go after the infringement.

Enthusiasts or not, you absolutely, positively may not use somebody else's trademark. You can reference it (comparative advertising,) but you can't use it in your own line of work.

The problem isn't Ford. They're between a rock and a hard place. If you think for a second that they don't get the value of the enthusiast market, I have some ocean front property in Idaho for sale. If they don't go after infringements, their balance sheets will go down in value, and the shareholders will vote in changes.

They don't have a trademark on the word period. They have a trademark on the word when used as a reference to their product. The Ranger Station, a site where forest rangers get together and swap stories about their exploits in the forests does not fall under Ford's copyright. The Ranger Station, a site about Ford Ranger trucks may be.
