Doing what's right is different than doing what's legal. I know the difference between right and wrong just as well as I know what's legal and illegal. Being ignorant of your local laws can get you in trouble, even quicker when a gun is involved and leaving the scene. There's plenty of local laws I'm sure I am clueless on. I would also not unholster my weapon in an injured animal situation without first knowing the law around it very well. If injured animals on the road were ever a daily problem for me I would be more concerned and educated on the issue.

Imagine the calls the local PD must have got on that situation. Nutty soccer mom: "This maniac jumped out of his car and shot a poor deer with a gun right if front of my little billy!! The deer was tripping and couldn't run away! Then the manic sped off in his car but I got his plate number!!". Doing what's "right" doesn't supersede the law. A call to the local PD explaining the situation and offering to help is easy, then staying around until they respond once a firearm is unholstered is a must.

If someone doesn't like their laws they should do something about it, start calling their congressman and writing letters. Just deciding oh this particular law is stupid and I feel what I did is right so I'm above the law attitude doesn't fly.

I don't want to dog pile on the OP I think he wanted to help and is now caught in a bad situation. I'm just saying in general terms, doing what's right is great just make sure it's legal. I also can say I must be a jerk because if I saw a wounded deer today on the street I wouldn't pull my pistol and shoot it in the city limits with people around. I would call the local authorities and get them to respond.

Here locally, if you hit a deer and it is wounded, the police department WILL come out and put down the wounded animal. Its a lot of paper work for the officer but they do not seem to mind ending the misery that the animal is in.

You did the right thing, but unfortunately in the wrong way. I quick call to the police would have saved you a bunch of BS and money.

You have to understand that the recent ruling doesn't mean that all gun laws are null and void. What McDonald did was open the door for lawsuits and challenges to remove restrictive gun bans and or laws. The true fruits of this case will be realized slowly, probably over the next decade or so.


And asking Pro2A groups for advice is not the answer. You should be asking these questions of your attorney. If you don't have a good defense attorney, one that is knowledgeable about firearm and self defense law, that you are on first name basis with then I suggest you seek one out.

The NRA may have a list of attorneys I your area. Call them for a few referrals. But it will be your nickel that will pay the bill.

I was driving home the other afternoon and a girl in front of me hit a young buck. The deer's back was broken and was running around on its front two legs in and out of traffic. I stopped and killed the deer with my pistol I carry on me when I'm out ....

... This is pretty common practice in the South to dispatch injured wildlife to prevent further suffering or vehicle damage from a frightened animal.

I would put the animal out of its misery as well; it's a shame you got in trouble over it.

Next time just go old school: break the buck's neck with your bare hands (like in the movie "the long kiss goodnight"), use a Rambo knife, or better-still, get yourself a Hakapik for the Jeep. It's a great tool; it's got a sledge hammer on one side with a massive hook on the other. It's just the right tool for dispatching seals, wounded bucks, or other various annoyances roaming around town lol.

A call to the police and a chat with them would have saved you a lot of grief before you pulled the trigger.......so would supporting someone who doesn't use the 2nd Amendment for toilet paper.

It could be argued that shooting the animal was self defense. If the animal 'attacked' you or others, or put your or someelses life in danger. I am not an attorney, so I'd check with one. Also, if it is a minor fine and doesn't affect Hunting or Fishing prevliages, then just pay the fine and move on.

Hey, its a "Surprising Little Town'. Just don't speed through it. I live out in Forest Lakes. Trying to get my MJ done.
I have hit a deer only once. It didn't pose any threat to any one. It was wailing and spinning its head. I did have a .45 AMT Backup on me at the time. I didn't shot it, but really wanted to. If I had a .22, I probably would have.
I think the cops are being jerks in this case. That is if the fine is a major deal, and suspension of fishing and hunting privelages go with that.
One guy I new from a machine shop I worked at, was a prison guard. He got out of that as things were getting a bit wacky, as far as prisoners freedoms, etc. He told me people would hit deer around his place from time to time. One the woman knocked on her door and was bloody. His wife, a nurse, took care of her. He went out and shot the deer. When he got back a cop was there. The cop started to lecture him. He didn't have time for it, and went back and got dressed in his uniform. The cops attitude changed a bit seeing the uniform.

What ever happened to the burden of proof? All you had to say is what deer? I have been home all day! Then the burden of proof lies with the cops and the so called witnesses. You really think they are going to run ballistics on a dead deer?
Here in California we have a problem with mountain lions which are protected, the rule is Shoot, Shovel, Shut up!
Next time make them prove a case, especially if they plan on taking your weapons.
