WAUSAU, Wis. – An American flag flown upside down as a protest in a northern Wisconsin village was seized by police before a Fourth of July parade and the businessman who flew it — an Iraq war veteran — claims the officers trespassed and stole his property.

A day after the parade, police returned the flag and the man's protest — over a liquor license — continued.

The American Civil Liberties Union of Wisconsin is considering legal action against the village of Crivitz for violating Vito Congine Jr.'s' First Amendment rights, Executive Director Chris Ahmuty said.

"It is not often that you see something this blatant," Ahmuty said.

In mid-June, Congine, 46, began flying the flag upside down — an accepted way to signal distress — outside the restaurant he wants to open in Crivitz, a village of about 1,000 people some 65 miles north of Green Bay.

He said his distress is likely bankruptcy because the village board refused to grant him a liquor license after he spent nearly $200,000 to buy and remodel a downtown building for an Italian supper club.

Congine's upside-down-flag represents distress to him; to others in town, it represents disrespect of the flag.

Hours before a Fourth of July parade, four police officers went to Congine's property and removed the flag under the advice of Marinette County District Attorney Allen Brey.

Neighbor Steven Klein watched in disbelief.

"I said, 'What are you doing?' Klein said. "They said, 'It is none of your business.'"

The next day, police returned the flag.

Brey declined comment Friday.

Marinette County Sheriff Jim Kanikula said it was not illegal to fly the flag upside down but people were upset and it was the Fourth of July.

"It is illegal to cause a disruption," he said.

The parade went on without any problems, Kanikula said.

Village President John Deschane, 60, an Army veteran who served in Vietnam, said many people in town believe it's disrespectful to fly the flag upside down.

"If he wants to protest, let him protest but find a different way to do it," Deschane said.

Congine, a Marine veteran who served in Iraq in 2004, said he intends to keep flying the flag upside down.

"It is pretty bad when I go and fight a tyrannical government somewhere else," Congine said, "and then I come home to find it right here at my front door."
 
On the one hand, it's theft. I'd file charges and force the issue. No doubt if he quit bathing, shaving, covered the stench with patchouli, waited a week and burned the flag, it would be free speech.

On the other hand, it would be fun to take turns hitting him in the face repeatedly until he figured out why he should display the American flag properly
 
I read the story this morning and had to shake my head. Crivitz is not a large town, and is fairly rural.

I understand people's feelings about the American Flag, however, flying the flag upside down is not illegal, and the guy did not disturb the peace by doing so.

There is a mistaken impression by many Police Departments that bad taste is enforcable by law. It is not. They illegally confiscated the guy's property. The question that will appear before the court will not be the flying status of the flag, or that the Police stole his flag (and returned it), but did they interfere with his 1st Amendment rights by doing so?

Because the flag was being flown that way in protest, it certainly appears he has a case.

Seems to me that he's just blowing his $200K investment by flying that flag upside-down outside his new restaurant....... I'm sure it'd get lots of folks excited to support his business......... :rolleyes:

Let the fool be disrespectful...... it's gonna cost him more than anyone else. :thumbup:

says the Village President is a Vietnam vet so I really doubt it has anything to do with being a Iraq vet.
 
I totally agree with the guy. The police removed his flag because others were offended?? Thats like saying you cant voice your opinion because others disagree!! Totally unfair in my opinion.
I might not agree with this guys message or methods, but i still agree with his right to say it.
 
i could see why some people would become offended from flying the flag upside down. the political punk band Anti-Flag is imfamous for having the upside down flag as one of their symbols, and people take this as an offense. however, the band is actually trying to put across another message which people dont realize: pro peace. note that on the bottom of the cd cover it says: 'Anti-flag does not mean Anti-American. Anti-flag means anti-war. Anti-flag means unity.' however, from a quick glance at the cover, the combination of the words "anti-flag" and the image of the upside down flag would cause common society to only see disrespect and not distress

I think this guy should have had a better game plan! who drops 200K and THEN realizes he cant get a liquor license?! As for the flag I don't think his "distress" is the distress they meant when they wrote the rules of how to fly our country's flag.

The Flag Code states, "The flag should never be displayed with the union down, except as a signal of dire distress in instances of extreme danger to life or property."

In my eyes it is totall disprespect. If I lived in that town and the police didnt take it down I would have. Yes I would have had to deal witht the reprecutions but that would have been my decision. Thousands of American soldiers have died for what that flag represents and he goes off and disrespects all of those lives, by flipping it upside down to protest a liquor liscence. Cmon! He could have found a better way to get point across. It was his town that turned him down not our country. And what better time to do this than 4th of July. All in all I think the guys is a duma$$ for dropping all that money and not securering the liscence first and then useing the wrong outlet to protest his idiotic problems.

The point of flying the flag upside down is to show distress, normally serious or dire circumstances, but to this guy its his distress at being let down by the system he served.
Spending $200k a waste? You can't just buy a building and get a license. You have to have a blue print of what its going to be, have that approved by city officials/engineers, then put it in action. After its all said and done, they can still say 'no' for whatever reason they come up with.

I can see how this guy feels a little let down. I would hope he takes the cops/city to court and wins. I feel cops should be respected, but for being good people, not for enforcing what they feel is right, but what IS right. The city, well its a town, not a gated community where you only get in for following certain rules.

I feel for the guy and I hope he can get his business up and running. But I feel the way that he displayed his anger was done totally wrong. He is displaying one of the many ways that this country is going into the crapper! He should feel lucky that he has the chance to open his own business. If he was in any other country one he most likely wouldnt have had the chance to open his club and two once he put that flag upsidedown he most likely would have been shot or imprisoned. People have no common sense these days and it is ruining our country. If I even thought about doing what he did I first would have porbably smacked myself and two I would have know someone was going to get pissed and somehow that flag would have come down.

As much as you'd like that to be so, it's not.

Link to the law that codifies and institutes a penalty for improper flag conduct. I'd be impressed if you find one.

Dissrespect is in the eye of the beholder. In this specific case, poor taste certainly applies.

The wife and I were chatting about this the other day and She was also really suprised that his "game plan" sucked so bad that he didn't look into the liquor license first. However, he wouldn't be the first business person to put the cart before the horse. It happens all the time.

As disrespectful as it was, it turns out to be prophetic. If you aren't breaking the law (according to the sheriff) and the police come on your land and confiscate your property. Then maybe this country is in more distress than you think it is.
