have filed suit against the Stanislaus Forest and they are starting copycat suits in other forest.

On August 12, 2010 three parties filed papers in the Eastern District of the United States District Court, Sacramento Division, for a "Complaint for declaratory and Injunctive Relief" against Susan Skalski, Forest Supervisor of the Stanislaus National Forest, and Randy Moore, Regional Forester, Region 5. The Plaintiffs are CSERC, or the Central Sierra Environmental Resource Center.
This is a statement from the lawsuit; "PEER is implementing a major campaign to stem environmental degradation caused by off-road vehicle use in public lands ......"
That sentence alone should strike fear into the heart of everyone who enjoys motorized access to our National Forests. PEER is on a campaign to eliminate motorized access and activity from our public lands, including our National Forest. This lawsuit proves the point. And PEER will not stop unless we stop them.
The option we have with this lawsuit is to seek defendant-intervenor status to insure we have a seat at the table when these issues are being discussed. What we would be doing is defending our right to motorized access to our National Forests, and making sure that we are there when these issues are being discussed. And, we have to come out figuratively swinging.
The way to present the strongest case is to present to the judge the strongest coalition, a coalition made up of a large cross-section of forest users, i.e. people on the ground. CSERC is trying to assert in this lawsuit that they are the ONLY group that sees and understand the conditions on the ground. WE know that isn't true, and we have to show the judge it isn't true. If we don't show him. he as no incentive to take any of our concerns, wants and needs into account. And, if we don't intervene, we have only ourselves to blame when there is a decision issued that we don't agree with, hurts our rural towns and cities, and denies access to the forest for hunting, fishing, OHV, camping, rockhounding, and the like.
One of our biggest concerns is the possibility of the U.S. Attorney's office of settling the case. If this happens, they would be taking with The Wilderness Society and PEER , taking their allegations into account, without getting any input from other groups. We can't let that happen!
We have also been told that this case is a test case for The Wilderness Society, and if this suit succeeds, it will be taken to every other forest that went through Travel Management in the state, and the effects will reverberate around the country.
We are at the forefront of this issue, and we have a choice to be involved. You can chose to be part of the coalition that is going in to fight this, and prove that we are all deeply committed to the health and well-being of our forests, and motorized access to our National Forests. It's really not a choice - it's a necessity.
What: Filing for Defendant-Intervenor status to defend the rights of motorized recreation enthusiasts, against the suit filed against the Stanislaus National Forest, by the Wilderness Society, PEER and the Central Sierra Environmental Resource Center.

Who: The California Association of 4 Wheel Drive Clubs (CA4WDC) is taking the lead on this filing, to defend the rights of motorized recreation enthusiasts throughout the state. We are forming a strong coalition of motorized recreation enthusiasts of all kinds - hunters, fishermen, campers, and all types of off-highway vehicles to stop this lawsuit from taking away our right to enjoy our National Forests.
