The problem is the US has gotten soft. It seems if you look at someone the wrong way something can be filed against you. The problem is the lack of states that use the death penalty.
Whenever I think of the death penalty I think of Ron White doing one of his stand ups where he talks about how in Texas if 3 eye witnesses see you commit a heinous crime, you don't sit on death row, you go to the front of the line. It's true, more states should do this, theres no reason that my tax money should go to someone who is going against society instead of going towards something for society.
But I agree with the person that says there has to be pain involved with the punishment otherwise the punishment means nothing. They go to prision for a few years and come out even more pist at society.
The thing that makes it so hard are cases like this. I just read in the news some guy sat on death row for like 20 something yeras b/c they thought he killed his g/f's kid. Well with new DNA testing it turns out that a neighbor actually did it and not him. So even though he was convicted if we had the no sitting on death row, he woulda been killed when he didn't do anything wrong. Its a tough fine line.
