insurance? paranoia?

ok, so i have a friend that has a pretty nice, mildly built 1990 xj, that he lovingly calls Cecilia. Cecilia was for a long time his daily driver and weekend warrior. he used to wheel with me on almost a weekly basis. one day, his parents decided to get paranoid that he, while wheeling, would somehow injure one of his passengers. They believe that his insurance would not cover any injuries sustained in a vehicle while off road, so they basically made him park his beloved Cecilia, and drive a Ford Taurus. they are completely terrified that in the event of an injury, they would be held responsible for whatever happened, and automatically lose their house, and everything else they've worked so hard for all these years, and that off road fun just isn't worth this risk. i told him that this is total bullsh*t, and that he should get insurance in his own name, and enjoy his life, and trade his taurus back to his parents for his testicles. what do you guys think? i know a few of you actually work for insurance companies, and you still go wheelin, with passengers no less! what makes you so brave?
 
Not sure about the insurance thing, but if the guy is of age, lives on his own, and owns the Jeep, he should immediately turn in his man card.

If the parents own the Jeep, the guy is under 18, or he does live with mommy and daddy, then he needs to suck it up unitl one or all of those things change.

Pretty simple if you ask me.

yeah, i told him both of these things. he's 21, i think, but he's in college, and his parents pay the bills. his parents don't think a waiver would hold up in court. his parents think that even if they cut the umbilical cord and let him pay his own insurance, they could still be held responsible since they help him pay for college.
 
Honestly, the waiver would be wort nothing in court. I have Allstate and when I floped the jeep earlier this year, I called them up and after answering a few questions, check in hand. My agent ask if I had passengers, and if anybody was hurt. They explained to me that legal wheeling was covered under insurance and I had nothing to worry about.

Well, it sound like he needs to suck it up till college is over. Once he quits getting the handout, then he can do what he wants. The parents hold the cards right now.

If the jeep is owned/registered in his name, and the insurance is in his name, no way anyone could come after the parents. He is an adult, and the responsibility would lie squarely on his shoulders.
 
yeah, that's what i thought. the jeep's in his name, and he wants to get insurance in his name for this reason. thanks, ckale1 that's exactly what i'm lookin for.

does anybody know if the 'legal wheeling' insurance situation applies in tennessee? my buddy lives in chattanooga.
he has been sucking it up for a year or two so far, but the taurus is actually less dependable than his jeep was, and it actually is in the parent's name, so he wants to go back to having a dependable ride, and not have to resist the urges that we jeepers feel...
 
My agent said that about 20% of people who have 4wheel drive auto's, actually take them off road. He explained it to me that Jeep shows them offroad in their ads and therefore they cover them. As far as legal wheeling goes, I think he just ment not tresspassing. I told him I was on a trail in a park along with the trail name and they were fine with it. I guess it would be the same if you had a farm and wrecked your truck on the farm somehow. You werent doing anything you should not be doing and had an accident. That's what the insurence is for. As far as states go, Dont see how that would matter.
 
When I put tags on my Zuk buggy with State Farm they would only allow me to pick up (Bodily Injury/Prop Damage) Liability.... Obviously that's all I wanted anyway... So, if he has insurance, it should cover (up to his limits) injury/damage to other's property even while offroad... I am supprised they will actually cover your rig when it's messed up though.. But I'd guess it's up to the agent you have.

If he kills/paralyzes a few occupants the yeah his parents have every right to be concerned about losing everything. Especially the way people will sue you over anything now days.
 
heeheehee.... well he has a nice mountain bike... i'll let him know, though for sure! he was a ton of fun to wheel with, but he currently has an apartment. he does stay with his parents over the summer, though. the jeep is in his name, so i figured he'd be fine if he just got some liability insurance in his own name for around 30 bux a month like i did...
 
Good call. i think the original fear might have come from a random person telling his parents that modified vehicles couldn't be insured under state law(bs), and they ran with that and let the fear get out of hand.
but as you all know, fear is the path to the dark side.
fear leads to anger, anger leads to hate, hate leads to SUFFERING!
by suffering, i mean not getting to wheel.:(
