'keet, I'd definitely be looking into your record. I'd be more than a little displeased with an officer telling me that I've got an arrest on my record as a falsehood (even if he was more than pleasant.) The thing is, if you've got a narcotics arrest on your record, your trouble is only beginning. How about court dates? Bench warrants for fail to appear?
I got a letter in the mail 4 years ago indicating that the plates on my Dodge were being revoked. After some investigation (took almost an entire day off work,) I found out that a false hit-and-run report had been entered against me, and that there was a warrant out for my arrest. I got in contact with the state trooper who wrote the report, and within 30 minutes, the warrant was cancelled and the accident report was rewritten. I was rather surprised that the officer was not interested at all in meeting face to face, or even in seeing my truck's condition. I was not happy that the rewritten accident report still cited "incidental contact" but if if wasn't written that way, the office would have to track down the individual who called it in and cite them for filing a false report.

Police officers aren't perfect. Sometimes they are looking for more than they should be. Sometimes big crimes are solved because an officers looks deeper than they normally would on a traffic stop.
Most local law officers have access to local records and if you have been in trouble for something they know it on a traffic stop, the computer in the car will tell us aLOT!
There should be a website for your state that you can search and see what your record shows in that state. Its a public site. Shows arrests, tickets, all documented interaction with the law. Indiana has one, its very in depth, and its very public.
If you check that and can't find anything, and if you feel like he went to far, there is an internal affairs division or officer or someone to complain to. They may not care, but you might feel better about it.
You could also contact the local court and ask them if you are in trouble.

Just remember we are human, we are people, and we have to answer to someone.
I'm not saying what happened was right or wrong. I wasn't there. If he let you go without any paper then count yourself lucky and go on your way.

Mac thanks for your insight. I have had two dealings with this particular department now and both times have been less than stellar. He had a valid reason to pull me over. I'm not complaining about that. I have to wonder if it was a ploy to "try and look deeper" or there has been a clerical error that will keep me from passing a background check in my job search. I personally think he was blowing smoke up my hind end to try and find something. Kinda like when I did get arrested the probable cause was my license plate coming back stolen. Did my due diligence and found no where in any local municipality did it come back stolen. I feel like it was another one of those situations.
I have looked on the county courthouse online record checks and can't find a thing on me. Even things that I know should be on there I can't find.

Wait..... you really did get arrested under the claim that your license plate came back stolen, and you discovered after the fact that it wasn't? I'd be more than a little displeased with that, that's worth going back to fight about. That's a false arrest, and I *DO* expect the officer to stand for it. I do expect officers to have the latitude to "follow their gut," but lying to me and putting an arrest on my record is not part of that.

We don't know the entire situation of that incident either Jeff. It could be that the officer was acting appropriately if he thought that the plate was stolen. There could've been a mistake. No one likes to put someone in handcuffs and then find out that there was a mistake, either on their end or the bmv or??? There are plenty of case law where the police have served warrants at the wrong address too.

The license plate thing was about 8 years ago. The stolen license plate was a reason to search my car. At that point in my life I wasn't a model citizen and they found contraband.. A good lawyer was out of my price range so I got a bad one and got put on probation.
This is why I'm skeptical of these situations when they arise now. And I just got off the phone with the guy that does all the record keeping for Johnson County and there is nothing on my record. Smells even more fishy now.

Its possible he saw your arrest from 8 years ago in the local system (assuming same agency), and made those comments to see if you were still involved in that kind of activity. Without explaining too much I understand the route he went in trying to search your car. Its a valid tactic without a warrant.

Different department that I was arrested with 8 years ago. When I just got off the phone with the county records guy he couldn't even find that charge either. According to the records department I have a clean record.
Just don't feel like I deserved being this guys fishing trip. I was honest and upfront with him, had all my ducks in a row, and never once was disrespectful to him. I understand he has a job to do and I don't fault him for that but with my son there I thought it was a little far.

Got it straightened out. The officer that I spoke with today looked into it. Apparently KC metro switched to a new reporting system this Aug. Since my old charge in 04 was migrated it showed new activity in Aug. The dispatcher gave the officer the wrong info. This makes me feel a lot better about the situation. I can't fault the guy for doing his job based on the info he had at the time. He was very professional through out the stop but based on my perception at the time I felt like it was a fishing trip.

So, the office was indeed running on the info that he was given. I have no problem with that, and I certainly would not be griping at him. He should be griping at the folks who migrated the data, updating records like that is a major problem.

Now that I have his side of it I have no issues. The issue with dispatch is being brought to the dispatch supervisor. My main concerns were A) I'm not a fishing trip waiting to happen and B) I was laid off last week and will be job hunting soon. I don't want someone else's charge on my record, if it was that could cost me a job. No harm done. If anything it was a good learning experience for my son. I showed him the proper way to deal with an officer that pulls you over. I feel that because of the way I kept my calm and handled my self, it kept the ticket from being written.
Most officers will treat you with respect if you do the same.

That's where the term good faith comes from. You would be amazed how much dispatchers screw up. I used to do that too...I know how they are supposed to do their job and I get very upset when they don't do it correctly. They do things that I know I would've got fired for when I did that job, and somehow the same people that screw it up still have a job...ya got me on my soap box lol...
