Looked like that thing was on "death row"...prob drove it back there off a trade in and no one had looked at it since. No mechanic check, etc...I would bet they had no idea it was 2wd and now they are just trying to keep your money cause they had $500 in it.

Who is the GM there now?
 
sounds like someone traded in something that they needed part off...

i knew a guy that traded in his TJ years ago...swapped the rear d44 out first for a d35 before he did tho...(wasn't me, never owned a TJ)

BBB. That's what they're there for.

Don't waste your time, the BBB is a self run organization, run by the members.
The members pay a membership fee to belong, with out membership fees, there would be no BBB, so they will not cut their nose off to spite their own face. And, if the culprit is not a member of the BBB, they will tell you that you should have only shopped their membership business.

The lawyer is actually my parents neighbor. I went to school with his daughter. He told me to tell them what he said in the second quote and if that doesn't work he will write a letter to the dealership for no fee.

I spoke with my neighbor today (attorney), I gave him the low down on my situtaion. He brought up a few good points that I didn't think about after speaking with the dealership.

The dealership sales manager told my attorney to talk to their lawyer, which he didn't have the name or number for, so my attorney has to wait till the GM calls him back. They sales manager said that they sold it to me "AS IS" and that I had the opportunity to look the vehicle up and down before I purchased it. My attorney brought up the point that from the exterior and interior it does show signs of being a four wheel drive vehicle. I told him yes, it has a 4wd front axle that only would be installed on 4wd vehicles (2wd's had different axles) and there was a shifter lever inside the cab indicating that the vehicle was a 4wd jeep. Which in a way nullifies the point that I could have looked up and down the vehicle before purchasing it, i did see the Dana 30 but didn't think to look for a TC.

I also ran the VIN# and it comes back as a 2wd jeep and the sales receipt says I purchased a 4x4. And the salesman lead me to believe that it was in fact a 4wd vehicle. So it seems like from what my attorney has told me that I do have a case for fraud, but I don't want to get my hopes up. It may be a few days before I hear anything back though.

Sorry for the long-winded post, but I figured some of you guys would be interested in this situation

The VIN comes back as a 2WD jeep, they claim they got the 4WD spec off the VIN.
The salesman acted like it was 4WD.
The front axle and shifter lever were there.

Yeah, I think you have a case (of the legal variety, not the transfer variety.)
 
Looking at the link again- I see they've got different pics of the xj up now. Didn't notice the -96 Tcase shifter and tire carrier before. Since it was covered in snow, you couldn't see the 4x4 logos were missing either. I wonder if they even knew, but that thing is sketchy regardless. Good luck; I'd be all kinds of pissed if that happened to me.

Turns out the guy has been waiting all day for AAA to show up ( he lives a couple doors down from me). AAA gets here and they won't come down my street since it hasn't been plowed or salted.....I pulled the heep out anchored to a tree and had him out in 10 minutes.

I said "next time leave a number and we can do this in the daylight." He asked if there was anything he could do and I said come fix my yard when it thaws.

If he doesn't hs yard will experience full throttle front digs.
