Hey so Troy... I was talking with one of my friends last night and the conversation led to DUIs... and she told me that you can refuse a breathalyzer, and that if you do they take you to a holding cell and need to get a court order for a blood sample, which usually takes long enough that most of the alcohol is out of your system and you get off with nothing. Is this true?
I don't drive drunk nor will I, I just thought this was a kinda interesting loophole.

For just a DUI charge, the State of Colorado allows for breath, blood or urine tests to determine alcohol content. A law enforcement agency only needs to offer one test, but most allow for a choice of breath or blood. If the person refuses either offered tests, then no test is done and they are charged with DUI. It'll be up to the Judge or Jury if enough evidence exists without test results to get a conviction.

Refusing to take a test (any one of the 3) will result in the person having their license suspended for 1 year by the Dept. of Revenue. No ifs, ands or buts. It's on the documents you sign when you get your driver's license that you'll cooperate with any and all parts of a DUI investigation to include the testing and refusal to do so will result in the 1 year suspension. You will not be allowed to apply for a "red" license to commute for school/work/emergencies.

If you're convicted of a 1st offense DUI, your license is suspended for only 3 months and it'll only cost you court fees if you plead guilty outright and you may be allowed a "red" license.

If you fight it and lose, it's gonna cost you court fees AND lawyer fees and you'll be charged for the Dept. of Revenue hearing regarding the status of your license.

If you fight it and win in court, the Dept. of Revenue doesn't have to honor your aquittal - simply being found with the presence of alcohol in your system over the legal limit is grounds enough for the D.O.R. to suspend your license. Doesn't often happen, but it can.

DWAI is a whole different matter. No license suspension on a DWAI, just court fees, loss of points on your DL. Dept. of Revenue doesn't get involved.

Driving While Ability Impaired.

One of my past co-workers told me a story about keeping you some place where you can't pee, and waiting for the alcohol to exit the blood. If enough time had passed that you might pass a breathalyzer, the alcohol will leave by another means, and have a higher concentration.

That was the mid-90s, I'm sure much has changed since.

Went yardin with my bud to get some parts for his niece's new ride. The Karma pot overflowed and he scored some 3.5" springs and LCAs for cheap.

We saw these drop brackets...

I got pulled over for a "random DUI check" a while back; not at a checkpoint.

Not speeding or any improper vehicle operation, current tags, no light or other vehicle problems/malfunctions. Stone cold sober, DDing the roommates; so I went along with the roadside. After I passed, I asked why I was stopped, and that's when LEO(Thornton) said that it was a "random check."

WTH is that!? I've never heard of anybody being pulled over for absolutely no reason other than to administer a "random" roadside. LEO even told me that he had no other reason to pull me over! Boredom? Borderline harassment/power trip?

not to mention a violation of your 4th amendment right against unlawful search and seizure -- that shite pisses me off -- sounds like a brownshirt asking to see if your papers are in order!:bs:
