I dont by any means have a blood lust. In fact the training I have as a private citizen makes me fully aware of when and when not to use my gun, that and the fact that I NEVER want to have to use it, EVER! I simply said dont come into my house planning on causing any problems or you'll have one on your hands real quick.
Second, We ARE an open carry state. I have read the law, but In some cases certain cities may enact there own law to prohibit it. That you must read on to find out if your city or town is ok to carry. Its a mess, and if your interested in the law go to this website, it has some great info. Granted I wouldnt carry into the mall open, that would get a scare real quick, but I am saying that I would carry around town or in the grocery store or gas station etc....as long as the private business doesn't have a problem with it. Just another one of those you must know the law real good.

well, that's all your opinion isn't it, and I can respect that. My tune didn't change, I just had to clarify what I said in my first post so you would understand. I guess we can agree to disagree.

Now, have I confronted people on my property with a firearm? Yes, I have, but when you're venturing outside at 2AM to see what the dogs are barking about, it's best to go prepared. Could I have been cited for brandishing? Yes, do I think that the police here would do that given the situation, probably not. Had I shot an unarmed punk trying to steal scrap metal then yes, I would have been taken away and charged with murder. It's all about meeting force with force, you cannot escalate the situation with your firearm.

Seriously though, as someone that carries a concealed pistol fairly regularly you MUST be aware of the laws regarding your use of a weapon, or you're going to end up just like this guy.
Personally, if they were driving at me, I'd have pulled the trigger too. If they're driving away from me with my trailer, no.

Do I think that charging an 80 year old man with 4 counts of attempted murder is a bit insane? Yes I sure do, but the facts are as such, you cannot use a firearm in defense of your property, only your life.

Depends on where you are. In Texas, it's perfectly legally justifiable to shoot someone trying to steal your car - comes under the old "cattle rustling" laws!

"Castle Doctrine" should be specific, however. Home and hearth only.
Property defense rapidly becomes a grey area. For instance, did you know that the judicial standard for "immediate lethal force threat" includes someone with a knife who is twenty-one feet (or less) away from you? The idea is that the distance can be closed and you can be on the receiving end of at least one attack inside of one second.
If someone is trying to grab your firearms or a sharp pointy object, it's perfectly reasonable to think that they are trying to arm themselves without a full assessment of the situation - which is why you are generally require to "should Halt! three times before firing." A 'warning shot' will usually get you put through the wringer - if you have time to fire a warning shot, you are not at immediate threat for your life. "Aimed shots" are similarly vulnerable in court - if you have time to aim for a knee, you're not at immediate threat for your life. Two to centre mass is usually the easiest shoot to defend in court - you're taking the largest target (which you'd do under duress,) and you're shooting to stop, not shooting to kill. The killing would be incidental, not the primary intended result.
I remeber seeing an SOF convention contest, on TV. It was one guy with a knife and an IPSIC pistol shooter. I think the knife guy had the knife in his hand, the pistol shooter was from the holster. The target was 25ft. They both hit the target at the same time.
