Need to vent for a sec

As some may know, Ive been working to sell our townhome for the past few months. The second round of buyers have removed all contingencies and therefore we removed ours for the house we are buying (since we cannot buy a new house without selling the old one)

The new owner has a super crew cab pick up truck that wont fit in the garage and the HOA won't issue a parking permit because they think its too big to fit in anyspace. I took measurements and found 11 spots that the truck will fit in sparing 2 feet. They argue that they dont think the guy would have enough room to maneuver the truck in and out of the parallel spots. They wont issue an outside parking permit and the whole deal could fall through if our buyers decide to back out but they would lose a hefty deposit.

Im at wits end. :flamemad:
 
I feel for you. That's the sort of story I hear that convinced me I could never live in a place controlled by an HOA.

Good luck with the sale. I hope it works out.
 
If the truck has auto plates on it, I would argue that they can't dictate where an auto could be parked. But, knowing HOAs, I guess they can do anything they want.

Does anyone else in the condo have a large vehicle like that already? Sorry to hear of your troubles.

Whatever they propose has to be in writing - 'Covenants, Conditions & Restrictions'. Does it say someone with a certain length vehicle can't live there?

CC&R and Parking Rules are two different documents. clearly state no recreational vehicles, commercial or 3/4 ton. Luckily even though his truck is long, its technically not a 3/4 ton.

There are no vehicle "length" limits. No rules being broken, HOA just doesnt want to approve an outside parking permit.
 
Buy the buyer another truck to keep the deal from falling through! Then keep or sell his truck.
 
ive thought about that but I wont really have any money after the transaction on the new house goes through.
 
I would ride them about this. If there are no rule violations then they can't deny a parking permit, IMHO. Know any lawyers?

Halfway competent lawyers don't come cheap. Buying the guy's truck and reselling it would be a much better investment, if feasible.

I didn't tell him to hire a lawyer. All you need is a properly worded letter telling the HOA that they can only enforce written rules - not invent them as they go.
