You wife got really lucky, or maybe the other driver was a really BIG idiot. In the state of CA it falls under the same "Basic Speed Law" and the rain and downhill are all bad for your wife case. She should have been going slower for the road and weather conditions leaving more room to break if the car in front of her stops. Yeah there might be a few caces that the person that ran into the back of someone is not at falt, like slaming on the breaks because someone is tailgating you etc etc etc. The CVC 22350 is not that hard to figure out.
If the other driver that hit your wife had a "good" reason to stop, it would be your wifes falt, or maybe a "no falt" but Ins. Co. hate that and will try there best to point a finger at someone. A simple "good" reason could have been "a cat ran out in front of my car" simple enough, a good reason to SLAM on the breaks! Now stoping at a green because you "missed your turn" that person is a idiot.
Also a "Stupid Did You Know" CA law. If you hit a dog in the road you must stop deal with the dog and at least try to contact an owner. If you hit a cat in the road you can keep on driving! :gag:
