I know but the guy has a 90% successful settlement rate with insurance carriers. He was my nemesis on Workers Comp claims.

Re: The Colorado BS thread

As long as it gets fixed at the shop I want, and they give me a truck to drive while mine is down I don't care. Although now I have an accident on this trucks vhr. :(

Take it to the local dealer, that way it'll be a factory certified repair. 50/50 chance it'll show up on the CLUE report if it's a FC job. It depends who his insurance carrier is too.

Did the little shit even have valid insurance?

Uhhhh...Colorado is an At-Fault State so since Mr. Douchebag was clearly at-fault, your insurance will subrogate (go after) his insurance for the claim amount. It doesn't matter who your carrier is - His carrier will be footing the bill. Hopefully the limits he purchased are enough to cover the damages.

Re: The Colorado BS thread

Ya I didn't get his anger to that either. He is 23 and it's 2012 mustang so hoping he has decent insurance. His is total loss is my guess. Do they pay me out first and short him? Or pay his out and short me therefore going on my insurance??
My insurance has to hate me lately.

Good question: However my answer to this would be far clearer about 4 beers ago.

In short, Colorado's minimum insurance limits are 10/20/10. Which basically translates to:

$10k per person
$20k per claim

So if he has the basic limits, and the damages exceed $10k for your vehicle, you would've had to have purchased Uninsured/Underinsured Motorist coverage. Since he's "underinsured" your policy would then kick in.

The fact that I typed that cogently is a fricken miracle - BTW.

Re: The Colorado BS thread

Lmfao. Makes sense. I do have under/uninsured I believe. Crap let me check.
I hope this doesn't become a debacle.

Re: The Colorado BS thread

Getting run into is contagious, Some old person backed into mine while i was in the grocers, and the a-- hole left a phony phone number under my wiper, But some one saw what happened and got his plate, and i went to the police and they got his info. When I contacted him he wanted me to get estimates so his insurance would;t go up, But screw him i went to his insure ace co ,, I hate old people

So what youre saying is, 'He saved 15% or more on his car insurance by switching to reverse and leaving the scene?'

Has the insurance industry ever done a study on the increased depreciation to a vehicle's value because of the vehicle history reports? Seems to me it's about time that the at-fault driver and/or his insurance should be cutting a check for that loss as well.

It's only fair that if I get smashed into and my car gets repaired, and then I get dinged at the dealer on trade in or have to sell to a private party for less because of the CarFax report showing an accident/repair on my vehicle history - that I didn't cause - there should be reparations.....

No?

Re: The Colorado BS thread

Troy that was my thoughts as I was talking about having an accident on the VHR now. wish it went down like that. or wonder if you can push for/request that?

Re: The Colorado BS thread

Seems to me a person might have a civil lawsuit claim for those reasons...... but you'd need some research in place to reference in order to establish a diminished value. I mean, the insurance companies already have it established that they won't insure a vehicle with a salvage title if it's been financed. Clearly they've identified there is a value difference that exists between a damaged car and a non-damaged car.

But yeah........ pisses me off to have to get a damaged and repaired vehicle back after something like this and my payment doesn't change. Nor will I get the anticipated sale value down the road.

Re: The Colorado BS thread

right. The info to support the cause would be nice. But while it would help the buyer it would kill the insurance companies to be paying that out. Probably why that hasn't been looked into.

Re: The Colorado BS thread

FWIW, USAA will both finance and provide full coverage on a rebuilt from salvage titled vehicle -- I have both a loan and full coverage on the Titan.

Re: The Colorado BS thread

oh im not worried about that. I was looking at it and apparently Colorado is a big supporter of diminished value claims, but getting it paid by the insurance is a pain at times. Curious what the difference will be.

When someone tries to escape their responsibility the gloves come off and I just straight up call insurance and let them get screwed.

If someone isn't a jackass at the scene and offers to just have my crap fixed, I'm willing to deal. You try and sneak away, get mouthy, or try to leave bogus info? Yeah you are getting screwed by the long dick of the law... and your insurance company. :rof:

Mike, I'm surprised you don't just have them slap a new bed/tailgate/rear bumper on it and call it a day. It will come out better in the long run and you won't have the corrosion concerns that you will if they weld a new set of panels on.

Actually, that gives me an idea. See if you can just get a check for the damages, then find someone who put a flatbed or work truck body on their truck and buy theirs. Bolt it on, get it painted, done. Probably come out ahead on the deal, too.
