so does anyone here know anything about the laws in this state?

i just got a phone call from the towing company.....FINALLY...and he says he just got off the phone with farmer's insurance and they said they aren't going to pay for the datsun.

he says tennessee state law says you hit the car, you pay for the car.

any advice would be helpful....i'm thinking i'll wait 30 minutes before choosing which one of my swords to take down off the wall.
 
i would say that it largely depends on your insurance coverage NOT state law... that sounds bogus to me...

just a thought but it sounds like he wants to try and get paid twice for one job... gets a check from the insurance co. and tells you they wont pay so you write a check too...
 
no he seems like a pretty stand up guy.

plus he's already bent over backwards letting the car sit there for over 2 months when he can get in trouble if its there more than 30 days.

and if the insurance company would have resolved it already i would have been contacted and the car wouldn't be sitting at the yard anymore.

it would be hard to get paid again for something that isn't there to pay for.
 
If you have full coverage the insurance company should pay for both cars if the accident was your fault (Her fault, if I remember correctly). If you only have liability then no, they won't pay for your damages, only damages to the other car.

What coverage do you have?

turns out that the adjuster needs me to try and find receipts for the cam, header, lowering kit, flowmaster, fiberglass bumpers, wheels, etc.

he's waiting to determine the value of the car.

the lady in front of jana swears up and down that jana hit her first then hit again after jana got hit.

because of this, farmer's doesn't have to pay for the car if the front end damage will total the car out. which there is no way it will.

its just stressfull.
 
You might want to calll your state insurance examiners office with your complaint. I had an insurance company trying to jerk my chain a few years back. A call to the state office lined them out.
