but its a question of how far your judgement is affected. 1 beer and your not going to go mow down a bunch of school children because you thought you were car bowling

Well, I don't see it quite as harshly as ajpulley, but I support his feelings.

Two congratulations are in order here:

One for K. Prickett for his admission and acceptance for what he's done.

One for the State of VA for actually sticking to their sentencing laws. Actually getting jail time for a second offense here in Colorado seems to take an act by God. I've personally charged a 5 time and an 8 time DUI offenders and neither has had to ever serve one day in jail. That ain't right.

XJ Ranger:

I dunno where you got that $10K first offense fine for our State. The statutory provision for DUI in Colorado for first offense is $500 - $5000 in fines and 6 mos - 18 mos in jail for the class 1 misdemeanor. The only time a DUI gets interesting is if a guy gets arrested for DUI and his license is currently revoked for a previous alcohol offense - that makes his bond $10k but doesn't change the sentencing other than to bump it to the $5000 and 18 months in jail. Now, if a guy was to get enough violations to be declared an Habitual Traffic Offender and then gets a DUI..... that makes it a $10K bond, and a felony charge.

No, that'd be if you were stoned.
Don't bring pot into this heinous discussion.

hmm - i rememeber reading a headline a few years ago and the intro to an article on my way through Denver Intl. that said what I had - "the most expensive drink you've ever had"...

maybe i should have read the whole article...

but if he had 1 or 2 beers and had to drive somewhere i hardly think he was a danger to society. BUT if he was S**t faced i think there is no excuse and i don't feel sympathetic at all. i guess by me being kind i was giving him the benefit of the doubt.

one beer or ten beers dosent matter. If your over the limit, your over the limit. PERIOD.

i agree with you good post, however in order to feel like you 100% i would need to know more details like how drunk he was. now a days it seems like if you have a quick beer (1) and say crap i forgot to get the BBQ sauce i gotta run to the store, and you get pulled over a block away from your house it seems you could potentially be illegal. i too have a little girl and it changed my outlook on alot of things, but if he had 1 or 2 beers and had to drive somewhere i hardly think he was a danger to society. BUT if he was S**t faced i think there is no excuse and i don't feel sympathetic at all. i guess by me being kind i was giving him the benefit of the doubt.

I was in fact shitfaced. I had NO business on the road. I could make excuses, but there are none that make up for what I did. My guardian angel that night was the cop that pulled me over and prevented me from doing anyone any harm.

I'd still appreciate some jail mail.

I'll take pics wheeling in front of the jail and send em to ya!!! *L* Just Kiddin....

I'll try to take some when we are up that way and send em to ya... Trying to run some trails around c-ville soon!!!

As somebody who had lost 2 classmates before graduation and been unfortunet enough to be on the wrong end of a drunk driver, I'm glad he isn't trying to act like a bad-ass or blame somebody else and taking his punishment. The drunk that hit one of the classmates I lost, when told he just killed three people, responded "So what, I've killed before" and the guy that hit me tried telling the cop that I hit him, even though there were plenty of witnesses in my favor and obvious damage to both his and my truck.

As I understand it, in most Middle Eastern countries, the last time I used my head would be just before I became severed from it.

FYI: In Lebanon there are no laws against drinking and driving. Hell there barely just getting traffic laws. You can drive like a madman, and its expected.

i was actually hoping not to hear that, at least your man enough to fess up and not sugar coat it. i have no sympathy for you and i think 30 days isn't enough to change someone who has 2 DUI's so far spread apart, i'm sure there are pleanty of other times you didn't get caught. i don't think you would be changing if you didn't get caught. i have a few friends in jail and some on Hueber (sp) work release, and they dont get nothing from me other than a friend when they get out. i'll make no promises, i understand people make mistakes but do us all a favor and actually learn from it

I made a really stupid decision, and luckily no one got wrecked, hurt or killed.
I got a DUI this past Thanksgiving, and tomorrow I'm going to jail for 30 days because I was also stupid 8 years ago when I got my first DUI.

I admit my stupidity and lack of responsibility. I ask for no sympathy and accept responsibility for my indiscretion.

I do ask one favor, friends. Send me pictures and letters of your work and your "stucks." Help keep me Jeepin' vicariously via correspondence. A month outside passes too quickly, a month inside stands still without something to pass the time.

I hope all works out well for you and your troubles but for everyone posting that they don't have sympathy for you, it clearly says that he wasn't asking for any. Just send the pictures and writeups and hope the guy doesn't get beat up or worse...

I am glad you do not drink either. It would be a Minor In Posession as well for you too, no?

About 6 months ago, a (former) friend of mine was released from jail. He served 7 years of a 10 year sentence for DUI. Heres the story...

He got his first DUI at age 17, got a slap on the hand.

He got his next DUI at age 23, his license was suspended and a court date was set.

Before he went to court he got his third DUI, this time he ran a red light and T-boned another truck, sending both occupants to the ER and totaling both trucks.

His father got him a good lawyer who argued that since he hadn't gone to court and been "punished" for the previous offense, he hadn't learned his lesson nor understood the seriousness of the crime.

The judge let him off with 10.
