Need some advice from you lawyer types (Chris around?)...

Finally found somebody that wants to buy my truck. Guy and his wife, pretty straight people, nothing shady or weird about em... but the only way they can afford the truck is with payments. He's a retired firefighter and on a fixed income. Wants to give me $2k up front and then $1k/month till its paid, which I can live with. But, obviously, I want some kind of legal document for him and I both to sign, with the total purchase price of the truck, how much he's giving up front, how much he's paying per month, how long it'll be till its paid, etc. I'm also gonna look into what to do with the title... I could keep it till its completely paid, but then he wouldn't be able to register it... maybe we could cosign? Or I could put a lien on it possibly?

This'd be my first time doing something like this, so any advice is welcome. I would like to do it, I haven't had a whole lotta serious interest on the truck and I really need to get rid of it.

Don't do it.

Best case scenerio:
He makes all the payments.

Worst case:
He makes no payments.
He enjoy's beating the crap out of your rig until it's worthless.
Abandons said rig and your left holding the title to a trashed POS.

A private seller should never accept payments.
100% cash, nothing else....even for family members or friends.


I agree 1000%. If the guy is trust worthy than He can go to a bank or Cradit union and get a loan to pay for the truck. I have done that in the past but, If he can't get a loan than you can't trust him to make the payments and If he doesn't theres not a lot you can do about it cause technically it's his truck and you can't reposses it unless you go through all the legalcrap associated with Repossing a vehicle..


Don't do it.

put it on consignment at a shop....he gets a loan for it, you get your money, and he gets to make payments...done

lawyer in the house...:cool: Frank, JD and Mike have it right -- I don't care how nice these folks are, you aren't a bank, and you don't have the means nor the economies of scale to act like one. Could I draw you up a contract and lien that would make it work, legally - sure. Would you still be jacked when you had a lien for a shitty truck and a year of missed payments, and finally a worthless judgment against a guy who you could never collect from anyways? yep. Not saying these folks aren't nice, but no one is nice enough for that risk.:twak:

Like everyone else has said, don't do it. There is a reason he wants to finance through you, otherwise he would just go to the bank and get a loan.

Thanks for the advice yall... that's what I kinda figured I'd be hearing. I'm supposed to call him tomorrow and let him know what I decide, I'll just suggest he gets a loan.

say you came to my shop, wanting to sell your truck. you say you want 9k for it, the dealer puts it on their lot for 11k++
so now you get the 9k you want if they sell it, they make 2k++ for being the ones to sell it and the buyer gets to go thro the shops financing

(++ means +tax and +dealer fees)

A retired firefighter should have GREAT access to credit union loans. Dunno why he'd even want to try to make payments to you...... it's risky for him as well....... Did ya read my Caddy CTS thread? What if you bailed on him? Not that you would, that's just a hypothetical.....

God dammit!!!!
Now that we are at the new store, and I'm no longer able to work 60-70 hours a week, they are taking me back to hourly pay, which with my schedule will work out to way less than the 'salary' I was on. Which still wasn't much anyway.

GRRRRRRR!!!!
