theres a bunch of us riding saturday but we're coming in from the lease side. lease keys are up this weekend and saturday is the last day to ride before we have to renew them. we're planning on getting there around noon and heading up the creekbed. should be at the pbb by 3pm i would guess? look for my rig, silver xj on 36's, fullwidths, no doors and the hatch is chopped.

jeepgeek: its open to anyone that comes in on the neighborhood side. thats the only easy "public" way to get in... just park more up toward the head of the trail. youll see tow signs n some no trespassing signs but all of that is old news so dont pay them any attention... the signs are from the legal battle the neighborhood has had going on for about the last seven years lol

From what I have heard there are two entrances. Through a neighborhood and through a gate that you have to pay to get a key. As for the legality of it... its private property in TN and some of the property is leased but not all the areas that they ride are a part of that lease.

The entrance is A PUBLIC ROAD. 100% Legal. Also, the guy who owns about 75% of the property that we ride on actually went to court to FIGHT the neighborhood so that it would be left open. I would like to offer him a sincere thank you. Without him it would have been closed years ago.

yupyup he pretty much kicks ass!

loaded up and heading out about 11am... gonna try to be on the lease and unloaded by noon and on the creek trail by 1230ish on our way up to the pbb.

Also strangely enough, the Hamilton county commission declined to close access last July:

Then Stein Construction withdrew it's request with the planning commission:

Now Stein is trying it again:

Like Tyler said, a special thanks needs to go out to Mr Fox and Dr Perlaky for their continued efforts in protecting their land from the developers.

It's my opinion that if the city ever becomes successful in annexing the property, then we will see the area closed and developed in to half million dollar homes.

As for now, on the public side there is sometimes a security guard sitting in his car to make sure that no one parks on the private portion that you have to cross to get to the road. All the security guards can do is ask you to move your vehicle off that property. Last time I was up there the guard even smiled and waved as I went through.

...same thing for me too

so how was the trip? probably pretty muddy, as it rained quite a bit sunday morning and saturday...

shaggy.. that last link you posted doesnt convince me its legal to ride there.
It sounds like a place i knew in Cartersville GA called Lucas.. people been riding there for 20 years but its owned by GA power. If theres signs of No Trespassing.. Chances are its not legal..

I've never seen trespassing signs... and I've always gone in through the neighborhood

It might be easy to assume the Lucas Rd wheeling area is owned by Georgia Power because there are power lines, but I've spoken to a property owner there and it's like so many other places- the power company uses emminent domain laws to force land owners to allow power lines to be built. The owners retain the land. They can have their friends over & ride their jeeps or graze their cattle if they want, but (obviously) can't cause erosion or do anything detrimental to the power system.

Now, if you don't have permission from the land owner, then yes, you are trespassing and the land owners at Lucas have called the po-po on a number of occasions. I don't ride there any more because one of the land owners asked me very nicely and I didn't want to be a tool.

Aetna? Heck yea, we should be grateful to Mr Fox and Dr Perlaky for keeping it legal for us.

well then .. naxja needs to through a ride out there then!
