if your apartment has a drop box for the money orders or how ever you pay. Tell them you dropped the letter off several weeks ago. Make one up with a date several weeks back and bring it to them to show them a copy. In this they cant prove you are wrong. Tell them you PAPECLIPED (not stapled) it to your last check for rent.

It would be so hard to prove you or them wrong. Case would be dismissed and both sides would be fine. ( most apartments are a little cooler than you think. Talk nicely and remember everyone there is just working. they arent God and the ultimate decision is theres)

Until they bring it to small claims court and you have to testify under oath. Still going to stick with that story after being sworn in?
 
Ya... trying to pull some kind of Tom Foolery could get you shot in the foot. Better to just talk to them and try to figure something out. I imagine they'd be more willing to work out smaller payments than to fight this in court/small claims/collections. More hassle going that route.
 
What does your contract say?

That's what your whole case hinges on. If it says your notice must be in writing, well shame on you. If not, methinks you should be in the clear.
 
i've been too busy to look at it lately.

i just figured she was nicer than that.

and its not like its coming out of her pocket.

this huge apartment complex is owned by a company that owns MANY more just like it.

she's always been nice to us and i assumed that when we sat down with her explaining our situation, she maybe would have mentioned "hey make sure you get me a written notice"


our problem was if we didn't get this house we wouldn't have been able to afford any others so we would have ended up not moving.


and we are RENTING not buying. still moving back to oregon in a year or so.
