so we are getting the keys to our new little house today and even though we stopped in weeks ago and talked to the apartment manager about us looking for a house, because we didn't give a 30 day written notice we have to pay full amount of rent for december.


ALL of our money just went into getting into this cottage.
 
What would they do if you didn't pay? Take your deposit & evict you? You have a house, so eviction isn't exactly a threat. Which is more, the rent or the deposit? Not that I'm advocating this route, but it is an idea. I guess if they wanted to be real asses they could try to put something on your credit report, but if you are like a lot of people your credit already sucks.
 
^what he said. when i left my old apartment, they wanted full rent for the month that i left, plus $500 for damages, on top of keeping my deposit! i told them to kiss my arse, and never heard from them again. it didn't even hurt my credit.
 
why is it always the renters responsiblility to fill out all of the uneccessary paperwork that they may or may not know about when it comes time to move??? thats retarded.

would be sweet if you knew someone that needed a place to stay for the next month... hehe

and on top of that we need to buy a fridge and washer for the new place.

joe, it isn't much, but if you want, next time i go home to jackson, i have a little mini fridge that you could either have or borrow until you can do better. i know you need a place to keep yer groceries. then again, if it stays cold, you could just keep stuff in a cooler on the back porch. just let me know, man. if i had a washer, i'd hook you up on that, too.

joe, yeah, man. it might be next weekend or so, but i'd be more than happy to bring it up with me. it's pretty tiny, but works like a champ.

And have probable cause to get you on breach of contract, thus more than likely racking up a lot more charges. Had a few friends through out college who were in a similar situation with their apartment complex leases. I've seen the contracts require anywhere from 30 days to 60 days prior notice before leaving, depending on the complex. Many of them automatically go into a month-to-month lease after the initial year if you haven't renewed or given proper notice of vacating.
 
Well, since you have a house now.. I wouldnt worry to much about your rental history. I would say eat the deposit and go on your way.
 
Being a rental house owner I have a different perspective. First of all I am not rich. I think people have a misconception that landlords are always rich. Every month of rent not paid means I have to pay the mortgage. Thats $800 on top of my personal mortgage. If I get a 30 day notice I can begin searching for a new tenant. Generally 30 days is plenty of time to get someone set up. Since I ask my tenants to give me a 30 day notice UP FRONT and they sign a contract agreeing to it I don't think it is a big deal.
 
all the get rich quick stuff that i know of involves either up front money for the job or moving out of state after the job... you get rich quick but if your caught you end up getting free room and board at one of the nations finest establishments, though the decor isnt great and the security is kinda inward... but free food and a bed :) lets hope we dont get caught *crossfingers*
 
Also as a landlord with multiple rental units, I agree with Bogosia. If you signed a contract requiring 30 days, well, you signed a contract.

One thing you could do, Joe, see if you can negotiate with the landlord. Tell him you will pay for the month that you owe him, but if he rents it before the 30 days are up, see if he'll refund part of your month's rent based only on the days the unit was unoccupied.

Say he rents it on December 15, that new renter will have to pay proprated 16 days of December rent until the monthly contract hits on January 1.
 
Coming from a situation where my wife is the apartment manager where we live...it depends on the owner of the property really.

We require a 30 day written notice, not just a verbal, "hey, i'm leaving on this date."

Why? Because it's part of the lease that you're told about up front and you agree to is upon signing. Just like the noise ordinance, when signing the lease, that's your last warning about having parties and being too noisy.

as mbogosia states, being an owner, for every rent that isn't paid whether late or never, that's $$ out of your pocket. Even if you have to evict someone that's typically more money out of your pocket, especially if you have to get the legal system involved, but you can always sue the person for the $$ but if they didn't have the $$ in the first place for rent, getting the rest might prove rather difficult (ask my sis in-law)

Another reason to try and work something out: Sure you might own a house now, but who knows what the future will hold? What if you're not able to make mortgage and are forced back into renting? Oops! Got a ding on your rental history =/

Also, some places will take you to collections. Why? Well, if one person decides not to pay rent and thinks they can get away with it, what's not to stop the rest of the tenants from doing the same?

My suggestion, talk to your landlord/manager. Unless they're a complete tool they should be willing to negotiate some kind of payment plan for you guys. Especially if you've been renting there for awhile and always have been good renters.

And in your situation, not to be mean, but at our place if someone is looking for a house, we have them fill out a 30 day written notice but with the stipulation that if they happen to need to live there a little longer than intended, they get pro-rated. So an estimated 30 day notice of departure would have been golden. Unfortunately that's in the past for you now =/
 
Cotton's idea is good too.

At our place, if someone moves out prior to lease ending, they are still responsible for each month's rent UNTIL someone moves into that apartment. Breaching contract...
 
im gonna be devils advocate as well... YOU shouldve read the contract and YOU shouldve known what was in store for you, for most larger rental payments they will take you to collections for it. When i moved out i gave them a tentative 60 day notice so they could at least have my apartment on their vacant list to get a new tenant, its even more important with a house as its usually one or two properties with a landlord and they are paying the mortgages on each...... and also anyone who has rented at all should be familiar with the 30 day practice, its pretty commonplace for all rental properties both apartments and houses
 
My apartment complex tried to pull that crap on me. They also charged me $1500 to replace the carpet! For some reason or another the apartment complex manager fired shortly afterwards.................She deserved it!
