what rocks do these people crawl out from under

That's a damn shame. I would bet the people that filed the suit has never been in or around the military, and doesn't know what the flag really stands for.

I saw that last night and got pretty pissed off. Still have the article pulled up on my computer at home so I can call/write to the HOA responsible for this. Absolute BS.

Yet another bunch of busibodies who want to run everyone's life. I hate HOAs and will never even consider buying property in a neighborhood "run" by one - why should I pay to be bossed around by some nosy fool and told what I can and cannot do with my property?

:gonnablow

Cue the jackasses coming in saying what good the HOAs do for residents. Kinda like saying that Hitler had some really good points, in spite of the bad things he did.

we live in a HOA too and i have found out over the last few weeks that theyre geared toward old people with nothing better to do than butt into other folks business

my jeep had a blue tarp covering it and a guy who lives up the street came and told me that it was ugly and it needs to go, i said well sir your pretty damn ugly too and we dont ask you to leave...show me where in the by laws it says i cant cover my jeep with a blue tarp...it is registered and inspected, he hasnt been back since, but the president (my neighbor who im very good friends with) did tell me i need to be nicer about some things haha

OH SNAP! Man, keep a video camera rolling next time you do that...

Next time I'd tell him you would cover it with a garage but don't have money for one, and ask him to maybe donate to the cause?

What a shame.

My grandpa has a similar pole, he is a ww2 vet also. I think it's awesome. Hell, I want one on my antenna on my xj.

It sucks when people are that anal.
It's a pole with YOUR country's flag. And you want it down? That's the real rule broken here.

That outstanding gentleman also has a newly opened Veteran's convalescent center co-named in his honor down here in Richmond, on the campus of the VA hospital. I was lucky enough to be invited to the commemoration and naming ceremony when it opened:

http://www.dvs.virginia.gov/carecenter_sitter-barfoot.shtml

Second Lieutenant Barfoot's official Medal of Honor citation reads:

For conspicuous gallantry and intrepidity at the risk of life above and beyond the call of duty on 23 May 1944, near Carano, Italy. With his platoon heavily engaged during an assault against forces well entrenched on commanding ground, 2d Lt. Barfoot (then Tech. Sgt.) moved off alone upon the enemy left flank. He crawled to the proximity of 1 machinegun nest and made a direct hit on it with a hand grenade, killing 2 and wounding 3 Germans. He continued along the German defense line to another machinegun emplacement, and with his tommygun killed 2 and captured 3 soldiers. Members of another enemy machinegun crew then abandoned their position and gave themselves up to Sgt. Barfoot. Leaving the prisoners for his support squad to pick up, he proceeded to mop up positions in the immediate area, capturing more prisoners and bringing his total count to 17. Later that day, after he had reorganized his men and consolidated the newly captured ground, the enemy launched a fierce armored counterattack directly at his platoon positions. Securing a bazooka, Sgt. Barfoot took up an exposed position directly in front of 3 advancing Mark VI tanks. From a distance of 75 yards his first shot destroyed the track of the leading tank, effectively disabling it, while the other 2 changed direction toward the flank. As the crew of the disabled tank dismounted, Sgt. Barfoot killed 3 of them with his tommygun. He continued onward into enemy terrain and destroyed a recently abandoned German fieldpiece with a demolition charge placed in the breech. While returning to his platoon position, Sgt. Barfoot, though greatly fatigued by his Herculean efforts, assisted 2 of his seriously wounded men 1,700 yards to a position of safety. Sgt. Barfoot's extraordinary heroism, demonstration of magnificent valor, and aggressive determination in the face of pointblank fire are a perpetual inspiration to his fellow soldiers.

What's happening to him is BULLSHIT

Wow. I guess HOAs are worse than Nazis, hope he takes them down a few notches too. Apparently they've hired a lawyer... I wonder if they realize that this will look really bad for them if it hits the mainstream news.

He signed on the line to live in an HOA, he asked them for permission, they said no. He did it anyways. As much as it sucks, if you choose to live in an HOA you also choose to abide by their rulings.

That said, I can't comprehend how they can deny him the ability to run a flagpole. It makes no sense.

not really Darky......what's not being publicized is that the HOA gave him an exemption a couple of years ago to allow the pole. Why he didn't put it up then I don't know, but the current board and president will not recognize the earlier decision.

I hope this thing blows wide open.

If its not specifically stated in the CCnRs or HOA bylaws, the HOA can eat a big pile o crap.

1st, let's get this clear, in my opinion the neighbors are wrong, it should always be appropriate to have a flag pole.

Interesting this came up. This morning on the ride in to work there was a lawyer on the radio explaining HOA CCRs because it is that tiime of year when neighbors turn against neighbors and start objecting to putting up Christmas light displays, Menorah's and Nativity scenes. He basically stating that these HOAs that were created to prevent blight, like XJs parked on front lawns on milk crates, are mini-"governments by contract" and you are basically at their whim. No one forced these people to purchase the home covered by a CCR.

Last May I didn't get much sympathy from folks here on the board when I got a ticket for parking my Jeep on the street in front of a neighbors house. Same issue, jackass neighbors with their panties all in a bunch.

The board then gave him an exemption. The board now says no. Kinda like certain things may have been allowed under previous NAXJA BODs, but aren't now. You abide by the rules set forth by the current BOD. When I worked at Hertz it wasn't specifically stated that you couldn't repaint the car, but you can bet you'd get charged for it if you did.

HOA are the devil! One of the many reasons I got the hell out of Florida. Hope he socks it to them!

Why the hell did he need an exemption in the first place? They don't specifically say anything about flagpoles otherwise and I'll be damned if I would take "aesthetics" as a reason to pull my not-forbidden flagpole down either, how does a flagpole look bad?

It's BS no matter how you look at it, unless you like paying to bend over and take it from a bunch of busybodies with nothing better to do than nitpick everyone else's lives.

The real question is what rocks are they smoking!

The Freedom to Display the American Flag Act of 200556 prohibits a
condominium, cooperative, or real estate management association from adopting or
enforcing any policy or agreement that would restrict or prevent a member of the
association from displaying the flag in accordance with the Federal Flag Code on
residential property to which the member has a separate ownership interest.

Awesome. I was about to say, this is going to lead to HOA's being declared Unconstitutional....
