rights of way

does amyone know what the rights of way of an underground telephone line is? can i find out through the town it is in, they should have a record or all easements and deeds, right?
 
Look on you Plat...it will tell you.

Utility easements are normally 10' , 5' either side of property line.

That can vary with location and etc.

Why might you ask? Did you make a boo-boo?

That right of way would be for the utility company and their product ONLY. The R.O.W. does not give you permission to trespass across any particular piece of land. Just so ya know....

If you don't own the land the R.O.W. is on, then you might not want to dig at all. That'd be considered destruction of private property.

Not true. If you've had all underground lines marked by a locator service, and then dig in an area free of markings and hit a line, guess what bubba? The locator service and utility company are liable.

As long as you are more than 18" away from the line formed by the marks/flags.

Yes very true. I know this because I used to run underground utilities. But he never said anything about having a locator find it tho. Was just stating if you are dorking around with a utility it is your responsibility.

Rev you are correct too 18in to either side of outside demensions of located utility.
 
The main utility lines must run inside easements or rights of way, but the lines that service each individual building can run anywhere within that building's property boundaries.

As far as the 18" rule, that depends on the state laws... In Utah the margin of error for utility locating is 24". Nationwide you now dial 811 to request location of utilities before you dig. In most areas, you must give 2 business days notice before you excavate to give the utility companies a chance to mark their lines. Hit something before your locate request becomes legal? Whip out your checkbook.

I'm a manager for ELM locating, we're a locate contracting company, meaning we do the locate work for utility companies. Just last week we had a company call in a locate request and they dug 6 hours before their request became legal. They cut a high voltage power line before we had the chance to mark it. Guess who got a bill for $2,345? Yep, the excavator.

Call first, wait, then respect/maintain those marks.

Few years back I snagged myComcast cable feed with a tiller, they wanted to bill me $300 to repair because I didn't have it marked first........until I asked them if their installation procedure includes running the Cable TV in the same trench as sprinker lines, buried 12" deep?

I later found out that their sub-contractor left the cable on the surface, as it was winter when they installed and never came back to trench and bury, so the previous owner just threw it in the trench when the sprinkler line was installed..........Comcast's sub came out and buried it properly and and I saw no bill.

I also found out that I have 2 900-pair phone cables on my back property line. I was able to dig 12 2-ft deep post holes with no issues, after having it marked, of course.

You never really know what you may hit when you dig, so get the stuff marked first before.
