Need to vent for a sec

HOA = stupid rules..

My sister received a letter from her HOA, saying the trees in the back yard where too tall..????
She is fighting back and arguing that other neighbors have bigger trees...lol

My old boss got a letter from and HOA who was trying to fine him for a missing tree in his front yard and some paint on the house number. Of course the tree never existed and the paint on the house number was there from when they built the house.

By any chance the buyer is able or does have a handicap plate, or atleast a placard? the ADA has strict laws allowing handicap parking even where there are no specialized areas. meaning you can have the curb in front of your home painted and then listed as a personal handicap parking space. unfortunately most HOAs trump state laws, BUT fortunately the ADA trumps most HOAs. never ever EVER try and fight an ADA issue. you will lose in court no matter what.

Agreed HOA's have stupid rules, but I would recommend your sister (and the OP) read all the HOA bylaws to either find a bylaw that supports their case or a loophole. The " they do it too" arguement is pretty weak. How does she know those same neighbors have not received a similar letter?

I successfully fought a neighbor who towed a friends truck because it was in front of his house. When I confronted him he went on and on about how it was his right per the HOA bylaws. He was right, but he failed to follow bylaw procedures by first notifying the HOA of the vehicle to have them ticket it, then tow after 48 hours. He paid the towing. :)
