National Emergency!


That does freak me out. Imagine Obama having the power to issue a national emergency. That is what you were talking about right? Oh yea and there is this part "The national emergency declaration was the second of two steps needed to give Sebelius extraordinary powers during a crisis"

We've been in a declared National State of Emergency since 1933 - that was never rescinded.

Therefore, this was a superfluous and redundant maneuver on Obama's part - but it can still give him extraordinary authority, now that the idea of a "state of crisis" is renewed in the national consciousness...

FDR declared a NSoE in 1933 for the Great Depression, giving him (at the time) rather unprecendented power to resolve the crisis. (NB: FDR was also our only four-term President - the Amendment limiting service of POTUS to two terms was passed later.)

While the NSoE is supposed to be officially rescinded as of the "resolution" of the crisis (we're dealing with 75 years ago now - I certainly hope the crisis has been resolved!) this NSoE was never rescinded with the crisis announced as "resolution achieved."

This means that every President since has had available an "officially declared emergency" to work with, and could have assumed authority under the Emergency Powers Act and started short-circuiting Congress.

And frankly, I'm not altogether sure why some of the power-hungry jackasses since haven't done so (Clinton comes readily to mind. As does Nixon. And Johnson.)

Therefore, the current "declaration of a NSoE" is redundant and not strictly necessary - a simple redirection of the NSoE still in effect - since 1933! - is all that would have been strictly and legally necessary. However, issuing a new current declaration renews the idea of a NSoE in the national consciousness - since most people aren't aware of the fact that we've technically been in a "National State of Emergency" for the last seventy-six years.

How's that for a translation? I find it instructive to note that, effectively, any President from FDR forward could have seized power over the country under the Emergency Powers Act at any given time - simply because the Great Depression was never announced as "resolved" and the State of Emergency declared over...

Other than it's not enough, and the chances are good that they're getting the wrong people, not a damned thing.

if i were to be included in the natural selection of people who die from any natural causes, so be it. nothing i can do about it. sure, itll suck. not my best moment, but atleast it was for a reason, not some driver who i pissed off who shot me (for an example).
