On Friday, January 27, 2006, in the Sacramento County Superior Court, EcoLogic and five OHV groups -- the Off-Road Business Association, American Sand Association, San Diego Off-Road Coalition, CORVA, and AMA District 37 -- filed suit against the California Off-Highway Motorized Vehicle Recreation Commission (the "Commission") to overturn actions taken by the Commission at its meeting in December 2005.

Specifically, the suit alleges that the Commission violated the Bagley-Keene open meeting law by holding private, secret discussions and making decisions on grant applications and program policies outside the public view and without public input. The suit also challenges the Commission's decision to approve grants that have little to no relationship with OHV recreation, and to deny grants that were clearly deserving of funding.

As stated in the complaint, the Commission's actions during and prior to the December 2005 meeting were illegal, arbitrary and capricious and reflect a distinct anti-OHV bias. This was illustrated by the Commission's complete rejection of grant funding recommendations made by the OHMVR Division staff. To correct this abuse of discretion, the lawsuit requests that the Court (1) void all actions taken by the Commission at the December 2005 hearing, and (2) direct the Commission to reconvene that meeting in compliance with all applicable laws, including the Bagley-Keene open meeting act.
