'92 4door in san diego

I've never bought a vehicle that was already smogged that wasn't from a dealer. I know that i've heard that its illegal to sell a running vehicle that cannot pass smog though. Is it actually enforced?
 
Yes it is. I bought a cj5 from a guy, who swore to me that it ran perfect and will pass with flying colors.
Failed miserably. (needs current smog to register and transfer ownership in CA)

He refused to give me my money back for the cj5.

Simple one day in Small claims court, and he had to fork over 2900 bucks to have the engine fixed. Took less than 10 minutes in court.
 
Solved with an as-is bill of sale. No problems. in 34 years of cali buying and selling.

Moot point, though, cuz I'm already set to get this rig smogged beforehand. :)

As is bill of sale still didn't fly in my situation. I was nervous at first, but unless the vehicle was sold with Non Op, then Smog cert is still required.

Once you have smog cert, I as well as a few more will be interested.
 
as is doesn't matter, unless as mako said it is already titled non-op or being sold as a parts vehicle or for scrap.
 
Just for verification if you are a buyer the DMV will only recognize smog certs within 30 days. In other words if you smog this thing and I buy it 2 months from now the smog won't be valid. I would have to get another one. However if the vehicle is still in your name the smog is valid for 90 days. If you are just renewing your reg.. But a transfer of owners is only 30. I would wait to smog until you have a buyer that at least gives you a deposit. No need to throw your money away. But in reality it is the sellers responsibility to smog the vehicle. Any time I have bought a car private party I have bought it as is and smogged it myself. Glws dude.
 
Jesus Christ... Seriously guys? I've bought I'm excess of fifty vehicles in California , mostly without smog. Quit busting his balls. It's an old jeep at a good price. It's a risk you take buying used cars. Half the junk i see for sale in here doesn't come with a recent smog cert anyways. Make this thread elsewhere. It's clear it's not coming with a smog certand it's getting way of subject

Just fyi, i'm outa town right now but i'll be back next week.

Going to pick up a smog cert and then hopefully sell this rig to another Jeeper to enjoy.

Really a good solid truck with a ton of maintenence and love put into it.

The smog is good for a 90 day window, and by law the seller is responsible for smogging the vehicle. Not sure where you heard 30 days at.

If a buyer wants to be an ass and there are issues with smogging it after they pay you for it, you're on the hook for getting it smogged. So if you do sell it with out a smog cert, get it in writing that the person is buying it for parts and has no intention of putting it on the road. Otherwise they could haul you into small claims court for the cost of repairs to smog it. Best to just get it smogged and sold in the 90 day window.
