Ok, so this morning I was involved in a very MINOR fender bender. I had pulled into the local biscuit place to pick up some breakfast before school, and there were no normal parking spots left. The only other option was to parallel park in this one little strip of the lot thats perfectly legal to parallel park in (even the owners of the restaurant park there). So i go inside, get my food, come back out, and go to get in the jeep, when an older guy approaches me and says "that was me". I look at him with that "what in the hell are you talkin about?" look and he pulls his business card with a short message on it from underneath my wiper that said "minor fender bender, hit front bumper, please call, sorry".

The way I was parallel parked, It was straight shot from the restaurant to my door, so I didn't walk across the front and notice the damage. So after reading the card i thought "oh great, i don't have a bumper anymore". So we walk around and much to my surprise, my bumper is still completely in tact. I have the "sport" model XJ, which means plastic front bumper on the corners. The exact corner of the passenger side front bumper is dented in, and my right front fender flare is scratched up (down to the plastic). Figure, OK this could be ALOT worse. Also, since the damage is minor enough, and the guy was nice enough to leave his card and everything, and talk to me face to face and in his words "pay for any damages", no need to get insurance involved.

So now here's where the questions come up. I went and got one estimate today (i've got several other places to go to tomorrow), and that was for $265. The reason being the entire right corner of the bumper shifted when he hit it, meaning it's bent at the brackets, so it's gotta be replaced (plus the bumper would be discolored, then the fender flare has to be sanded down, primed, repainted, and all that other fun stuff, and then theres labor. Now since i'm not paying for the damages, i'm not concerned about price, but more about quality.

The questions are (didn't I already say that???), can I get a rental car out of him for the time my jeep is in the shop being fixed? The one estimate I got said about 2 days, and I still have school I gotta get to, as well as work. I wouldn't go for a caddy or anything, just a basic econo box to get around in untill I get my jeep back. My mom's gotta have her jeep to get back and forth to work, so I can't share hers. Also, as with any other late model Sport or SE with the plastic trim, they're extremely faded. However, right now they look good because I put a protectant/restorer on them on a regular basis to bring the color back and keep it there for a while. When I do get it fixed, I'm going to go with an OEM bumper, meaning it will be new, and not faded, which would make it not match with the other corner of my front bumper. Would be it fair to ask for the other one to be replaced also, regardless of the fact that it wasn't touched?

Most people i've talked to today are wondering why i'm even getting it fixed. I look at it as, I work too damn hard to pay for somebody elses mistake. Had I done similar damages out on a trail or something, I would live with it, and probably have a good memory to tell about it.

BTW, not that it matters, but it was a GMC Yukon that hit me (Suburban dressed up).
 
IMO I would fix was he messed up and give the guy a call about a rental for a couple of days. Find out what it cost first and be up front with the guy. I had a similar experience when my wife rear ended some one and her "Fiend" was telling her to get as much as she could from us. This pissed me off and I told her to get an estimate to fix the car and show it to me and any more than that I would bring it to my insurance company.
 
I told him i'd get some estimates and get back to him over the weekend with a price. I was planning on ironing out the finer details afterI talked/met with him again. I just wanted to get some more opinions from others who have been in similar situations.

Well, I just got somewhat screwed over in an accident situation, so right now I'm taking a no-holds-barred stance. Ask him to take care of complete repairof it, including the rental/courtesy car. If he balks, tell him you have no choice but to report it as an accident and let his insurance take care of it. If it were me and I'd hit someone, I'd want to pay for everything myself rather than have my insurance raise my rates in order to recoup from me tenfold over the next decade.

It was no fault of yours. Your Jeep should be restored to the exact or better condition than it was previous to the accident. You're not being a dick by asking for it to be completely repaired with no inconvenience to yourself. You shouldn't even be calling for estimates. I would call the most reputable place you can find for a quote and tell the guy who hit you that's where you're going. If he doesn't like it, let him do the legwork to find a cheaper place of the same quality. If you were driving a fancy-dancy Lexus, would you settle at all? The only thing that I will caveat with here is that I don't think its fair to ask him to replace things that he did not damage just because they will look a bit different due to fading. That's not really his problem. The damage he did do, well that should be repaired perfectly...

He returned our phone call today and said for us to bring him an estimate and he'd write a check. When asked what about a rental car, he said (talking to my mom since the Jeep is in her name) "Well I think he should be responsible, since he was parked illegally". THAT is a load of CRAP. I most certainly was not parked illegally. There are no signs stating "no parking here", and I was not hidden behind any other vehicle or any obstacle. My jeep was plain as day (how do you miss a dark green jeep in broad daylight??? ohh wait I know, you can't see much in that school bus....errrr.....Yukon thing he drives). So on my lunch break today I went and talked to the manager of the restaurant, explained the situation to him, and showed him where i parked. I got a witten statement from him saying that there is no sign stating I can't park there, and they have nothing against anybody else doing so (there were about 4 or 5 other vehicles behind me).

I then called the PD of my town, and talked to a Lt. He said that where I parked was perfectly legal, unless otherwise posted, and in this case, i'm completely in the wright, and he doesn't have a leg to stand on. I also got that in writing and faxed to my house. He also said if worse came to worse, that we'd have to battle this out in civil court. If thats what it takes, i'm game for it. I want my jeep back the way it was, at the least inconvenience to me, is that too much to ask?

I'm doing everything I can to leave insurance out of this and make it as easy as possible for everybody. He's just about left me no choice but to contact his insurance company. And if thats what it takes, I have no problem doing so. He's only digging himself deeper.

From now on any kind of accident i'm involved in with any kind of damage i'm filing a police report. Thats where I went wrong in the beginning.
 
nope. And if he gives me any more crap, thats exactly where i'm goin.
 
My advice at this point is to go ahead and involve the insurance company. I think he's already given you more than enough indication that he's not going to make this simple. See if its too late to file a police report too. It might not be. Play the ignorance card, say this is the first time this has ever happened to you and that you feel you were manipulated by him into not reporting it, but now he's dicking you around and you want to 'open a file'...
 
this is a lesson just about EVERYBODY has to learn the hard way. DON'T EVER JUST BE THE "NICE GUY" AND LEAVE IT UP TO THE OFFENDER TO PAY FOR IT. always, and I mean ALWAYS involve the insurance companies. that's what they're for.

i was involved in a similar situation years ago. and... i learned my lesson the hard way! a VERY "minor" fender-bender turned into a three-week long shenanigan, because i let the guy talk me into not going through insurance.

never again!!!
 
maybe I'm just a little more laid back than you all, but the two times I've been rear ended and had MINOR cosmetic damage, and the other driver, who was clearly at fault, got out of thier car and apologized and offered to pay for it, I just said THANKS, but that's not really necessary, just watch where your going next time.
 
If I was driving a piece of crap with rust and other dents, I would agree wholeheartedly, but if your vehicle is cherry and you were not in the least bit at fault, then they need to take responsibility. The other guy backed into his Jeep. Its his fault and he should pay to repair it perfectly...

I Agree, If I had a show quality car or it was brand new off the lot, or if the other guy was an A-hole, but when it's a good looking 16 year old girl, and her front bumper is a mess, and she's about to cry, and I've just got another dent, I'll save her the pain of having to report it.

Thats exactly how I feel about it. I work too damn hard to afford this Jeep, and just about everywhere I go i get tons of compliments on how well it looks for its age, because i believe in keeping what I work hard for in good condition. I know that accidents happen, and i've got no problem with the fact that it happened. But be a man about your mistake and fix it right, stop tryin to get out of it.

I'm done making this easy on him. Going to have a little chat with him in the next 30 minutes or so at his office and see what i can't get out of him. Maybe if I embarass the hell out of him at his place of business, he'll see things my way.

And yes, I have learned quite the lesson with this. We're going on almost a week since the incident and not much progress. I really don't want to have to go to civil court, but if thats what it takes, then thats what it takes.
 
dunno if it's too late but if it's only a day or 2 that your ride is out of commission, try to catch a ride if at all possible. It sounds like you're in high school so it shouldnt be a huge hassle. Wouldn't you appreciate that is you were on the other end... karma's can be a bitch; what goes around comes around... :lecture:
 
why dont you just get a check for the estimate and just drive your jeep the way it is. you can just get the bumper fixed another day? when its more convenient for you?
 
Well I had a little chat with him today and got a check for $300. That covers the cost of repair, and one day rental car. Once he saw the written statements from the manager of the restaurant and the PD, he suddenly had a change of heart. I can live with a one day rental, or better yet, i'm trying to work it out to where i wouln't need it, and still not be late for work. Just getting to school and lunch is the issue. I'm gonna go deposit the check tomorrow and make sure it clears the bank before i go any further though.
 
So.....let me get this straight. You got through all of that trouble to get the guy to pay for a rental and then you decide," Wow, this could be some free cash if I just tried to work around it".

I could understand getting the rental if you worked/went to school all day and you absolutely couldn't get around it. But to turn around and try and work the guy like that...... props to the guy for owning up to his mistake and offering to pay it off right there.

Well lets see, If I can work it out to where I don't have to take the time to get a rental for a day, swap cars, then return it at the end of the day, spending double the ammount of gas in my moms jeep in the process, then yes, I will get the work done and pocket the rest. I know it sounds bad, but wouldn't you? You're forgetting the guy tried to fight me to even pay for the estimates I orig. had, so I had to go out and get more. Besides, what does he care? Once it clears the bank it becomes MINE and I may do with it as I please. Besides, I could take that extra $50 and do something fun for a change, or buy a tank of gas or two. Also keep in mind I do have a loan that I still owe a ton on, I could put it towards that, or even into my savings account. Soo many things I can do with just a mere $50.
 
You mention class are you in high school or a college?

When I was in high school I always felt they were mostly trying to keep us busy and would have said "cool I have a legitamate excuse not to go."

If youre talking about a college or trade school of sorts maybe you don't want to miss a class but I was always able to schedule classes so I could only go 2 days a week.

Could you bus it? I took the bus a long time before I started driving and still use public transportation for various reasons (like if I don't finish what I'm doing to the XJ). That or pick a conveinent day to miss class.

Seriously, I would be saving my $50 bucks for something else if I were you.
