calling all LEGAL types.. need advice please

in a nutshell.. i live under the "neighbor-from-hell" i could go on for pages about this guy but i will try to keep it simple... first off i am a renter in a 2-family home... owner lives across town... who is the loser upstairs?
a suposedly"injured-at-work" unemployed crack-smoking drunk who hates the world..... no job.. rarely actually leaves the house.. no income to my knowledge.. (however there may be insurance money now) nice guy when he sees me around the driveway.. i've been here 2.5 years and when i moved in i was "assured" he wasn't going to be here long... as of last april i was complaining about him and was assured again they had a court date set to evict him.. at that point he was like 14 months behind in rent... he's actually been somewhat "quiet" for the last few months and i am TOO easy-going and give everyone the benefit of the doudt.. i generally don't/haven't complained to the owner much because i don't rock the boat generally.. i know.. thats my own fault.. but it does not make this my fault that i'm listening to the beatles tonite at 1230AM...

what has he done that directly affects me??
loud music at all hours of the day and night.. seems to corespond with his woman problems...
he's a childish type and the 1 time i actually called the police to my house at 2AM he turned it down for all of 5 minutes and then proceeded to holler death threats down thru the floor at me and stomp around the house until about 530AM, and i sat up all night watching my Jeeps in the driveway in the dark for the next week..... i have chosen to refrain from calling them again since he is childish enough to retaliate by messing with my stuff.... i have thousands of $$ of tools and equipment in cellar that is shared.. i visitors at all hours of the night... through my personal experience and proffesional training i am pretty sure he's getting regular deliveries of some type of drugs... i hate being below him so much that even when i hear quiet foot steps cross the floor my blood boils..... he has been drunk and verbally confrontational in the yard once this last summer, in front of my kids even! sometimes i wish i was not so even tempered these days.... i live here with my 2 daughters and i really can't afford to move... and i don't feel i should have to.... there is so much more to this story but i'm so angry right now i cant even concentrate.... i am sending a letter to the owner in the AM demanding some sort of action be taken....
WHAT ARE MY RIGHTS AS A TENANT??

i'm really looking for constuctive advice and solutions here guys... i'm not in the mood to joke about this...

Damn, I feel your pain. I was in the Army for 6 years and had to deal with all sorts of inconsiderate idiots.

Aside from moving (you state that is not possible), and aside from sabotage (dead fish, shutting off hot water, and other fun (but not legal) stuff.... you need somebody that knows the laws in your area. I would suggest contacting one of those inexpensive legal aid outfits to see how to best proceed. That may include letter to the owners, county, city, etc.... and will take some time I bet.

Good luck to you. I hate people that make noise. If you are quiet, there is still some propert available out here on the island I live on. Worst noise is the Navy P-3s and A-6s. They generally are quiet after 10pm though.

if its at all possible, video tape these outbursts threats...... that way, if anything happens to you or your stuff, you have some proof.
 
i just composed a 2 page letter to the owner thats hitting the mail tommorow AM .... my biggest problem i think will be "lack of proof" since i have not complained much nor called the PD... and by complaining now i feel like the asshole....

i composed a letter to the owner and it went out today... my biggest problem like i said is the fact that i havent been vocal enough about this.... so its not "documented" and i'm probably back near square 1....

I had a friend who had a problem with the exact opp. we were the sopposed people us stairs we werent ever that loud and even when we were just talking he would call the cops. So we thought what could we do to piss him off and we new he was really into plants so we killed all of his plants and did other stuff that I really dont want to say but he got evicted the next week but it was fun while it lasted.

Complaining to the folks in charge at every level, from the property owner on up through the city, county, and state, is the way to go. Be loud, be articulate, be accurate, be relentless, be the squeaky wheel. Everything must be in writing though, or it doesn't count.
All that said, you're more than likely screwed and should give up and move to a different state. Massachusetts is far too liberal to do the right thing for an upstanding taxpayer. They'd much rather blame you for the societal stresses that cause your neighbor to act as he does - it's all your fault don't you know!
 
that's my plan... what i know i should have done all along... you are soooo right about this liberal state... now i have to decide if i'd rather deal with the "politics" involved in living in Utah.... that's a tough call there..

Crap! and I have to go back to that place for a week next week :( After spending 18 years living among the Massholes I moved south (thanks to the Army) and stayed, for a reason.

At least they have good snow and my little bro has a snowmobile upon which I can partake in some 1st-class yuppie terrorizing on my favorite old (no motors allowed anymore!) trails. If there is a real god, it'll be a smokey & loud old sled too! With no back flap so the track throws a good rooster-tail :viking: Then, after proper havok is wreaked, I can hie-de-hoe back to the nice warm South, with a bounty on my head in at least Norfolk & Middlesex counties, (more if I get ambitious) and not return until the statute of limitations runs out.

Thanks to the liberals & yuppies for ruining my homeland! :mad:

i havent been called a "masshole" since i was in Virginia 15 years ago... must be a southern thing i suppose.. but that may be a good name for a state full of democrats who keep voting for republican governors...
